Terms and Conditions for Verification Badges
For the purposes of this document, the term “Australian Gold and Silver Jewellery” shall be referred to as “AGSJ.” Any reference to AGSJ throughout this document refers to Australian Gold and Silver Jewellery. The term “holder” in this document refers to the business or individual who is acquiring the badge for the set period.
*1. Eligibility* – The verification badge is available to businesses and individuals who meet the criteria set by AGSJ. To qualify, applicants must: – Provide accurate, truthful, and complete information during the application process. – Maintain a good standing with AGSJ, with no violations of the group rules. – AGSJ reserves the right to approve or reject any sponsorship application at its sole discretion.
*2. Badge Activation and Usage* – *Badge Activation: * – The verification badge is activated once the applicant successfully meets the requirements set forth by AGSJ. – While it is not mandatory to list with the badge, AGSJ requires the use of it to utilise the benefits along with the keywords “Trusted Seller” to activate an alert that allows for inclusion in the Featured tab of AGSJ’s platform. Usage of this keyword is optional and does not guarantee listing in the Featured tab. – *Badge Usage: * – The verification badge represents an affiliation with AGSJ. Usage is restricted to applications directly related to business promotion and brand affiliation. – The badge must not be altered, duplicated, or used in any manner that misrepresents AGSJ or the holder’s affiliation. – Any misuse of the badge, including but not limited to inappropriate placement or misrepresentation of the badge’s significance, is strictly prohibited. – AGSJ reserves the right to request removal of the badge if misuse or misrepresentation occurs.
*3. Listing Inclusion* – By using the recommended keyword “Trusted,” your listing may trigger an alert for AGSJ’s review. This may result in your listing being displayed on the Featured tab. – AGSJ retains full discretion in determining whether or not a listing will be featured, and inclusion is not guaranteed. – Featured listings may be rotated or updated periodically, and there may be no permanent placement in the Featured section.
*4. Verification Badge Validity* – The verification badge is valid for a defined period, as agreed upon during the agreement. The validity period may be specified in the contract or promotional material. – At the end of the validity period, the badge may automatically expire unless the badge is renewed. Renewals are subject to the same terms and conditions as the initial agreement.
*5. Fees and Payment Terms – *Processing Fee: *A non-refundable processing fee of $29 is required for all applications. This fee covers administrative costs associated with processing your application and is charged regardless of the application’s outcome. *Verification Fees: * – If applicable, all verification fees must be paid in full before the badge is activated. *Payment Methods: * – Payments for the badge may be made via approved payment methods. AGSJ reserves the right to set and modify fees for the verification badge at any time. *Late Payment: * – If payment is not received within the specified time frame, AGSJ reserves the right to suspend or revoke the verification badge until outstanding payments are made. * Refunds: * – All approved verification payments are non-refundable unless AGSJ deems it necessary for a refund to be issued (e.g., if there was an error with the activation of the verification badge). * Unsuccessful Applications: * – Applicants who are not approved for verification will receive a refund of the badge fee, minus the non-refundable processing fee, within 10 – 15 standard business days from the notification of the application’s outcome.
*6. Intellectual Property Rights* – *Ownership: * The verification badge and all associated intellectual property, including logos, trademarks, and design elements, are the exclusive property of AGSJ. – *License: * By obtaining the verification badge, the holder is granted a non-exclusive, non-transferable license to use the badge during the verification period, subject to these terms and conditions. – *Prohibited Actions: * Holders may not copy, alter, or sublicense the badge or any associated intellectual property.
*7. Changes to Terms and Conditions* – AGSJ reserves the right to modify or amend these terms and conditions at any time without prior notice. Any changes will be communicated to holders through email or via AGSJ’s website. – Continued use of the verification badge after the changes have been implemented constitutes acceptance of the new terms.
*8. Termination and Revocation* – *Termination by AGSJ: * AGSJ reserves the right to terminate or revoke the verification badge at any time if the holder: – Violates any terms outlined in this agreement. – Fails to comply with AGSJ’s policies, including those regarding payments or listing content. – Engages in conduct deemed inappropriate, unlawful, or unethical by AGSJ. – *Termination by Holder:* The holder may choose to discontinue using the badge at any time, but no refunds or credits will be issued for the remaining duration of the verification period. – *Consequences of Termination: * Upon termination, the sponsor must immediately cease using the verification badge and any associated branding or marketing materials.
*9. Liability and Indemnification* – *Limitation of Liability: * AGSJ will not be held liable for any damages, losses, or claims arising from the use or misuse of the verification badge, including but not limited to: – Errors or omissions in featured listings. – Loss of business or reputation resulting from the removal or suspension of a listing. – *Indemnification: * The holder agrees to indemnify and hold AGSJ harmless from any claims, losses, or damages arising out of their use of the verification badge or failure to comply with these terms.
*10. Privacy and Data Protection* – AGSJ respects the privacy of its badge holders and will handle all personal and business data in accordance with applicable privacy laws and AGSJ’s privacy policy. – By applying for the verification badge, the holder consents to the collection and use of their information for the purposes of managing the verified trusted seller program, including sending communications about updates or changes. *11. Dispute Resolution* – In the event of a dispute arising from the holder agreement or use of the verification badge, the holder agrees to first attempt resolution through informal negotiation. – If an agreement cannot be reached, the dispute will be resolved through arbitration or mediation, as determined by AGSJ.
*12. Governing Law* – These terms and conditions are governed by the laws of the jurisdiction in which AGSJ operates. Any legal action must be brought in the appropriate court within this jurisdiction.
